MINUTES of the Meeting held in the Committee Room, Swale House, East Street, Sittingbourne on Wednesday 27th April 2011 from 10:00 am to 10:40 am.

Present: Mr Chris Maclean (Independent Member and Chairman), Swale Borough Councillor Adrian Crowther and Parish Councillor Graham Addicott.

consideration of complaint no. sbc 0005/10

The Interim Head of Legal and Democratic Services introduced the report which set out a complaint referred from the Standards Referrals Sub-Committee to the Director of Corporate Services/Monitoring Officer for investigation about a possible breach of the Code of Conduct. The Monitoring Officer had arranged for this matter to be investigated and the Investigator's report on this matter was set out as a confidential annex.

RESOLVED:

(1) That under Section 100A(4) of the Local Government Act 1972, as amended, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Paragraph 1 of Part 1 of Schedule 12A of the Act.

a) consideration of complaint no. sbc 0005/10

The Sub-Committee determined that it accepted the Investigator's report that there was no breach of the Code of Conduct by the Parish Councillor in question.

The Sub-Committee considered that there were issues that could be addressed through training, in particular minute taking, the conduct of meetings and management and resolution of conflict.

RESOLVED:

(1) That there was no breach of the Code of Conduct.

(2) That the Standards Sub-Committee recommends that the Parish Council receives training with regard to minute taking, the conduct of local council meetings and management and resolution of conflict.
 
 

b) consideration of complaint no. sbc 0006/10

The Sub-Committee determined that it accepted the Investigator's report that there was no breach of the Code of Conduct by the Parish Councillor in question.

The Sub-Committee considered that there were issues that could be addressed through training, in particular minute taking, the conduct of meetings and management and resolution of conflict.

(1) That there was no breach of the Code of Conduct.

(2) That the Standards Sub-Committee recommends that the Parish Council receives training with regard to minute taking, the conduct of local council meetings and management and resolution of conflict.
 
 

c) consideration of complaint no. sbc 0007/10

The Sub-Committee determined that it accepted the Investigator's report that there was no breach of the Code of Conduct by the Parish Councillor in question.

(1) That there was no breach of the Code of Conduct.

(2) That the Standards Sub-Committee recommends that the Parish Council receives training with regard to minute taking, the conduct of local council meetings and management and resolution of conflict.
 
 

d) consideration of complaint no. sbc 00010/10

The Sub-Committee determined that it accepted the Investigation Officer's report that there was not a breach of the Code of Conduct by the Parish Councillor in question in respect of Paragraph 12, but there was a case to answer in respect of Paragraphs 5 and 9.

The Sub-Committee considered that there were issues that could be addressed through training on the conduct of local council meetings, in particular minute taking, and improved knowledge of the Planning system.

RESOLVED:

(1) That there was no breach of the Code of Conduct in relation to Paragraph 12.

(2) That there was a case to answer in relation to Paragraphs 5 and 9 and that the matter be referred to the Standards Determination Sub-Committee.

(3) That the Standards Sub-Committee recommends that the Parish Council receives training on the conduct of local council meetings, in particular minute taking, and improved knowledge of the Planning system.
